GENERAL DELIVERY TERMS OF PiRi REiS TRAVEL - 'TURK HOTEL MARKET.COM'.
  PiRi REiS TRAVEL® is founded in Ankara, the capital of Turkey in 1998.   We have an Group (A) Travel Agency Licence Number - 4270 from the Association of Turkish Travel Agencies.

Description :
PiRi REiS TRAVEL, having its offices at Antalya City, the Turkey at  (07160 P.K.) Sirinyali mah. No: 37/4, hereafter referred to as TURKHOTELMARKET.COM, is the provider of an on-line hotel reservation system. TURKHOTELMARKET.COM maintains and exploits websites of its own and also provides links to websites of third parties. These sites are hereafter referred to as the 'Websites'. TURKHOTELMARKET.COM is prepared to include information of hotels on its Websites and to facilitate the reservation of accommodation at the participating Hotels via its Websites. Hotels participating in TURKHOTELMARKET.COM are hereafter referred to as 'Hotel'.

TURKHOTELMARKET.COM uses the following General Delivery Terms with respect to services delivered to the hotel:

1) Information, liability and complaints :
Information to be included in the Websites has to comply with formats and standards provided by TURKHOTELMARKET.COM. The Hotel is at all times responsible for a correct and up-to-date statement of the information, including cancellation and no-show policies. The Hotel will also indemnify TURKHOTELMARKET.COM in respect of each and every liability arising out of the infringement of copyrights (e.g. regarding to photographic material provided by the Hotel) and claims by guests concerning erroneous information of the Hotel on the website or any other claims related to services provided by the hotel. TURKHOTELMARKET.COM excludes any and all liability in respect of the Hotel which is related to a (temporary) breakdown of the Websites. Complaints made by Guests are to be dealt with by the Hotel, without mediation by TURKHOTELMARKET.COM.

2) Translations, use of hotel information and prohibition of direct references :
The Hotel is not allowed to include telephone numbers or other direct references to the Hotel in the Website information. Neither may other websites be mentioned nor may any references be made to hyperlinks to the website of the Hotel or that of third parties. TURKHOTELMARKET.COM retains the right to translate the information provided by the Hotel into other languages and to shorten or standardize it. If TURKHOTELMARKET.COM has any indications that the information about the Hotel on the Website is not correct, TURKHOTELMARKET.COM retains the right to exclude or adapt the information. TURKHOTELMARKET.COM is entitled to offer the information and special offers made by the hotel on the Website via or in collaboration with (the websites of) third parties.

3) Authorisation by the Hotel :
The Hotel grants an explicit authorization to conclude agreements on behalf and for the account of the Hotel with guests arising out of bookings made via the Website. The Hotel is bound to accept the guest as a contractual party, and to deal with the booking in compliance with all the information contained in it, including any supplementary information and/or wishes made known by the guest. Proof of the fax message or e-mail having been sent by TURKHOTELMARKET.COM to the Hotel shall also act as proof of receipt of the booking by the hotel aside from counter-evidence to be provided by the Hotel.

4) Availability :
The Hotel commits itself to make available a minimum number of rooms, bookable via the booking-tool of TURKHOTELMARKET.COM. The Hotel carries its own responsibility in ensuring that TURKHOTELMARKET.COM is informed of additional availability of rooms for certain periods, or may choose to introduce updates directly and on-line into the system.

5) Rate parity guarantee :
The Hotel guarantees that the price mentioned on the Websites corresponds to the best available price for an overnight stay and that a better price may not be obtained by booking with the Hotel itself or via another party or via another medium.

6) Commission : 
The Hotel is due to pay TURKHOTELMARKET.COM a commission based on a percentage of the stayed room sales and other components as mentioned by the Hotel on the Websites, except in the case of a timely cancellation by the guest. The other components may comprise breakfast, meals (half-board or full-board), bicycle rental, theater tickets etc. The commission due will be calculated on the rates published on the website, i.e. including VAT. The minimum commission percentage is agreed separately between TURKHOTELMARKET.COM and the Hotel. To obtain a higher ranking, the Hotel may unilaterally increase the commission percentage and the availability of rooms; this can be done on-line.

7) Guarantee of the booking made by the guest :
Guarantee of the booking is based on the credit card details provided by the guest or the person responsible for the booking. The Hotel is responsible for the verification of the validity of these credit card details and the limit of credit on the date of the overnight stay(s) booked. If the credit card offers no guarantee, the Hotel will invite the guest to guarantee the booking in an alternative matter. If the guest is unable or unwilling to do this, the Hotel may cancel the booking. If the guarantee made by the guest may not be effected for any reason this shall always be for the account and for the risk of the Hotel. The reservation to the guest is guaranteed, in case of an overbooking the hotel takes full responsibility to accommodate the guest and will pay commission to TURKHOTELMARKET.COM.

8) Cancellations, no-shows, longer or shorter stays :
With the exception of the situation prevailing as described in article 7, only a Guest may cancel a Booking. In the case of a cancellation being made of a Booking by a Guest with the Hotel itself, the Hotel is to ensure that within eight days after the close of the month in which the stay should have taken place, this is reported to TURKHOTELMARKET.COM by using the Reservation Statement, which is made available online by TURKHOTELMARKET.COM. The online Reservation Statement can be accessed by using your pin-code. The same Reservation Statement can be used to inform TURKHOTELMARKET.COM, within eight days after the close of the month in which the Guest stayed at the Hotel, about longer or shorter stays of the Guest. After this period of eight days, the total amount of commission due to TURKHOTELMARKET.COM is calculated on the base of the final Reservation Statement. In case of a no-show, in which a Guest, without having cancelled, does not make any use of the previously booked overnight stay, the Guest shall be due to pay the Hotel as described in the confirmation to the guest and the Hotel shall therefore be due to pay TURKHOTELMARKET.COM a commission corresponding to the amount charged by the hotel to the guest. Hotel is to ensure that it reports no-shows to TURKHOTELMARKET.COM within eight working days after the close of the month in which the no-show occurred.

9) Monitoring of data :
Adjustments to the Reservation Statement, reported by the Hotel, are monitored constantly by TURKHOTELMARKET.COM, to ensure their correctness. For this purpose, we use reviews submitted to the Guests. If the monitoring shows frequent misrepresentations of data, resulting in damage to TURKHOTELMARKET.COM, or a systematically high number of adjustments made by the hotel, TURKHOTELMARKET.COM will exclude the Hotel from further participation.

10) Invoices and payment :
Invoices will be based on the information contained on the Reservation Statements, returned monthly to TURKHOTELMARKET.COM after having been duly confirmed and, eventually, adjusted by the Hotel. Reservation statements that have not been confirmed by hotel in time, i.a. within 8 days, are deemed to have been confirmed by the hotel. Invoices are processed on a monthly base and are sent to the Hotel by mail, fax or e-mail. The commission invoice is to be paid within 14 days from the invoice date by the Hotel. As a matter of principle, since the validation of the amount of commission due to TURKHOTELMARKET.COM has already taken place through the confirmation and returning of the Reservation Statement by the Hotel, payment of the respective invoices will always be settled by direct debit, if TURKHOTELMARKET.COM is able to facilitate this method in the country where the hotel is located. Only in exceptional cases and against conditions to be determined individually will TURKHOTELMARKET.COM agree to payment by bank transfer with additional cost. Other means of payment like cheques or via so-called payment agencies cannot be processed by TURKHOTELMARKET.COM and will therefore not be accepted. TURKHOTELMARKET.COM retains the right to terminate participation of the Hotel in case of systematic late payment of the invoices.

11) Ranking :
The order in which the Hotels are listed on the website, the so-called ranking, is determined unilaterally by TURKHOTELMARKET.COM. This ranking is automated and based, amongst others, on the current commission percentage to be paid by the Hotel, the minimum availability stated by the Hotel, the so-called conversion (i.e. the number of bookings related to the number of visits of the hotel-page on the website), the sales realized by the Hotel, the number of cancellations, the guest reviews and payment patterns of the Hotel. The Hotel has the possibility to influence its own ranking in an advantageous way by increasing the current commission percentage or the number of available rooms. This can be done online and by the Hotel itself. It is not possible to claim to TURKHOTELMARKET.COM about the ranking decided by TURKHOTELMARKET.COM.

12) Assignment :
TURKHOTELMARKET.COM has the right to assign both the delivery of its services as well as the entitlement to commission to its partners or third parties.

13) Termination :
Hotel and TURKHOTELMARKET.COM may terminate this agreement at any and all times and without reason given, in compliance with a period of notice of 14 days. Parties can not charge each other for any damage upon terminating the agreement. After termination of the agreement, the Hotel has to honor all booked bookings for the upcoming period and is still due to pay any and all commissions that already had been charged, if necessary increased with interest and additional costs.
